TERMS & CONDITIONS

Below are the Owner’s responsibilities in regards to storage/business of power, sailboats, automobiles, RV’s, and Motorcycles on premises at Cleveland Marine in Cleveland, OH. Time and Materials will be charged for any services or repairs necessary for storage at the normal hourly rate.

  1. Storage Fees beyond the stated period will be invoiced at published daily rates of $50 per day (with no discounts available), in effect at the end of the contract period, and are subject to change as those published rates change. Storage Fees are accrued if a quote is not approved and/or an invoice has been sent and not paid within (3) Business Days and the vessel is on CM Property.

  2. CM reserves the right to sell or dispose of any item that has unpaid fees for a period of thirty (30) days. At thirty (30) days a $500 Vessel Appraisal Fee will be charged.

  3. Cleveland Marine (CM) agrees to provide for the storage of the item listed on the storage contract for the period of time: October 15th - May 15th of the contract year and is provided on a “first-come-first-serve” basis.

  4. CM will determine the actual square footage when the item arrives for storage and the Owner agrees to any price adjustments from oral or electronic estimates/quotes that may be necessary.

  5. Failure to submit a Winter Storage Contract by September 30th and any payment(s) due thereof, may result in forfeiture of any storage reservation/services (50%), the other 50% must be paid one week in advance of the storage period. No refunds will be issued if the contract is canceled by the client or payment is not met by the week before the client hauls out.

  6. All Storage fees must be paid in full and the Owner must provide a Certificate of Insurance with Cleveland Marine, LLC named as additional insured, one week in advance of the storage period, unless prior authorized. A $50.00 Fee will be charged for any returned checks.

  7. Payment for any additional services requested after initial storage rendered by CM must be paid in full before the item is removed from CM property. 

  8. Keys to all vessels must be given to CM. The owner also gives permission to CM to move items within the storage area to access other items in storage, prepare items for the owner's pickup, or in case of any emergency.

  9. Items may be moved to access other items in storage. If it is necessary to move a boat/vehicle that is in storage after May 15th of the contract year, CM reserves the right to invoice the Owner for costs associated with the move.

  10. CM shall not be responsible for or have any liability whatsoever for any loss, damage, personal injury, or loss of property or life within the control of CM, Its employees, or its agents in connection with (1) the premises of CM or the use of its storage space, (2) the owner's items and associated equipment, (3) any loss due to fire, theft, vandalism, collision, CM equipment failure, windstorm, rain, tornado, or any other act of God or casualty loss. The owner agrees to cover these risks with appropriate insurance coverage without subrogation against CM.

  11. No person, other than the Owner, shall perform work on the item without the prior approval of CM. CM also reserves the right to limit the scope of work being performed by the Owner. At no time is the Owner permitted to perform work on the item’s electrical or fuel systems while in the indoor storage facility.

  12. All items must be emptied of the majority of fuel and have no more than five (5) gallons of gas in the tank. All batteries must be removed or disconnected from boats in the indoor storage facility.

  13. The owner shall comply with all rules and regulations established by CM and shall not engage in activities that are in violation of any city, county, state, or federal law or ordinance.

  14. The location of the item in storage will be at the discretion of CM.

  15. CM will attempt to meet the haul-out and launch date requested by the Owner. Dates are available on a first come first serve basis and are subject to change.

  16. Any vessel/vehicle that is sold while in storage will NOT be removed until after May 14th.

  17. The Owner is responsible for paying any haul-out or launch fees directly to the facility providing the service.

  18. Any parts that are special ordered or ordered direct from the manufactuer, once ordered and submitted we are unable to return or refund for those parts. All special order items and parts ordered directly from the manufactuer are not returnable or refundable.
